

{"id":15618,"date":"2013-11-01T00:00:00","date_gmt":"2013-10-31T23:00:00","guid":{"rendered":"http:\/\/ricom-web.com\/gestions-hospitalieres\/cme-et-cte\/"},"modified":"2018-04-05T10:40:39","modified_gmt":"2018-04-05T08:40:39","slug":"cme-et-cte","status":"publish","type":"post","link":"https:\/\/www.ricom-web8.com\/gestions\/cme-et-cte\/","title":{"rendered":"CME et CTE : consultatifs, forc\u00e9ment consultatifs !"},"content":{"rendered":"<span class=\"span-reading-time rt-reading-time\" style=\"display: block;\"><span class=\"rt-label rt-prefix\">Temps de lecture\u00a0: <\/span> <span class=\"rt-time\"> 5<\/span> <span class=\"rt-label rt-postfix\">minutes<\/span><\/span><p class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">Parmi les premiers \u00e9l\u00e9ments de cette \u00ab autre page \u00bb, deux d\u00e9crets du 20 septembre modifient, d\u2019une part les comp\u00e9tences de la commission m\u00e9dicale d\u2019\u00e9tablissement (CME) et du comit\u00e9 technique d\u2019\u00e9tablissement (CTE) des \u00e9tablissements publics de sant\u00e9, d\u2019autre part la composition de la CME<\/span>\u00a0<span class=\"char-TC_txt-Local-5\"><sup class=\"appel\" data-toggle=\"modal\" data-target=\"#notes\">(2)<\/sup><\/span><span class=\"char-TC_txt-Local-3\">. C\u2019est \u00e0 l\u2019aune des objectifs du Pacte de confiance (en l\u2019occurrence \u00ab renforcer la d\u00e9mocratie \u00e0 l\u2019h\u00f4pital \u00bb et \u00ab mobiliser toutes les instances pour assurer une gouvernance \u00e9quilibr\u00e9e \u00bb) ainsi qu\u2019\u00e0 celle des textes pr\u00e9c\u00e9dents, d\u2019application de la loi HPST, que doivent \u00eatre appr\u00e9hend\u00e9s ces deux d\u00e9crets. Premi\u00e8res analyses et mises en perspective. La loi HPST et ses textes d\u2019application ont modifi\u00e9 en profondeur la gouvernance de l\u2019h\u00f4pital. Pour ce qui est de la seule CME, deux modifications importantes doivent \u00eatre rappel\u00e9es :\u00a0<\/span><\/p>\n<ul>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">En premier lieu, la loi HPST a donn\u00e9 pour mission principale \u00e0 la CME de contribuer \u00e0 l\u2019\u00e9laboration de la politique d\u2019am\u00e9lioration continue de la qualit\u00e9 et de la s\u00e9curit\u00e9 des soins ainsi que des conditions d\u2019accueil et de prise en charge des usagers. Au passage, le l\u00e9gislateur d\u00e9chargeait ainsi la CME (supprimant la formation restreinte) de toute comp\u00e9tence en mati\u00e8re de questions individuelles relatives au recrutement et \u00e0 la carri\u00e8re des praticiens.\u00a0<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">En second lieu, la composition et l\u2019organisation interne de la CME n\u2019\u00e9taient plus prescrites par le code de la sant\u00e9 publique mais laiss\u00e9es pour une part importante \u00e0 la libert\u00e9 de chaque \u00e9tablissement, via son r\u00e8glement int\u00e9rieur.<br \/>\n<\/span><\/li>\n<\/ul>\n<p class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">Le d\u00e9cret du 20 septembre relatif \u00e0 la CME ne remet en cause ni la premi\u00e8re ni la seconde de ces modifications. Ainsi, les attributions de la CME dans le domaine de la politique d\u2019am\u00e9lioration continue de la qualit\u00e9 et de la s\u00e9curit\u00e9 des soins sont inchang\u00e9es. Nulle comp\u00e9tence de la CME en mati\u00e8re de questions individuelles n\u2019est r\u00e9tablie. Sa composition demeure du ressort du r\u00e8glement int\u00e9rieur de chaque \u00e9tablissement. Qu\u2019apportent alors, pour la CME et le CTE, les deux d\u00e9crets du 20 septembre? Essentiellement une habile retouche des comp\u00e9tences consultatives de ces deux instances et, cons\u00e9quemment pour la CME, des comp\u00e9tences en information ? Le dispositif nouveau doit \u00eatre appr\u00e9hend\u00e9 en deux strates<\/span>\u00a0<span class=\"char-TC_txt-Local-5\"><sup class=\"appel\" data-toggle=\"modal\" data-target=\"#notes\">(3)<\/sup><\/span><span class=\"char-TC_txt-Local-3\">.\u00a0<\/span><\/p>\n<p class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">Premi\u00e8re strate : les articles R. 6144-1 (CME) et R. 6144-40 (CTE) contiennent un socle de six comp\u00e9tences consultatives communes aux deux instances permettant une consultation \u00e0 l\u2019identique de la repr\u00e9sentation du personnel m\u00e9dical et du personnel non m\u00e9dical de l\u2019\u00e9tablissement, \u00e9vitant par exemple que la CME ne soit pas consult\u00e9e alors que le CTE pouvait l\u2019\u00eatre, instaurant par l\u00e0 m\u00eame une gouvernance \u00e9quilibr\u00e9e entre ces deux instances locales de dialogue social. Il s\u2019agit :\u00a0<\/span><\/p>\n<ul>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">des projets de d\u00e9lib\u00e9ration du conseil de surveillance ;\u00a0<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">des orientations strat\u00e9giques de l\u2019\u00e9tablissement et du plan global de financement pluriannuel ;\u00a0<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">du plan de redressement ;\u00a0<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">de l\u2019organisation interne de l\u2019\u00e9tablissement ;<br \/>\n<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">des modalit\u00e9s d\u2019accueil et d\u2019int\u00e9gration des professionnels et \u00e9tudiants ;\u00a0<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">de la gestion pr\u00e9visionnelle des emplois et comp\u00e9tences.\u00a0<\/span><\/li>\n<\/ul>\n<p class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">Seconde strate : les m\u00eames articles d\u00e9gagent des comp\u00e9tences consultatives sp\u00e9cifiques aux deux instances, en lien avec la nature des acteurs repr\u00e9sent\u00e9s au sein de cette instance. Pour la CME, cela concerne :\u00a0<\/span><\/p>\n<ul>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">le projet m\u00e9dical de l\u2019\u00e9tablissement ;\u00a0<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">la politique en mati\u00e8re de coop\u00e9ration territoriale de l\u2019\u00e9tablissement ;\u00a0<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">la politique de la recherche clinique et de l\u2019innovation de l\u2019\u00e9tablissement ;\u00a0<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">la politique de formation des \u00e9tudiants et internes ;\u00a0<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">la politique de recrutement des emplois m\u00e9dicaux ;\u00a0<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">le contrat pluriannuel d\u2019objectifs et de moyens ;\u00a0<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">les modifications des missions de service public attribu\u00e9es \u00e0 l\u2019\u00e9tablissement ;\u00a0<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">le plan de d\u00e9veloppement professionnel continu relatif aux professions m\u00e9dicales, ma\u00efeutiques, odontologiques et pharmaceutiques ;\u00a0<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">les modalit\u00e9s de la politique d\u2019int\u00e9ressement et le bilan social ;\u00a0<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">le r\u00e8glement int\u00e9rieur de l\u2019\u00e9tablissement ;<br \/>\n<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">le programme d\u2019investissement concernant les \u00e9quipements m\u00e9dicaux.<br \/>\n<\/span><\/li>\n<\/ul>\n<p class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">Pour le CTE, ces comp\u00e9tences sp\u00e9cifiques sont :\u00a0<\/span><\/p>\n<ul>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">les conditions et l\u2019organisation du travail dans l\u2019\u00e9tablissement, notamment les programmes de modernisation des m\u00e9thodes et techniques de travail et leurs incidences sur la situation du personnel ;\u00a0<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">la politique g\u00e9n\u00e9rale de formation du personnel, notamment le plan de formation ainsi que le plan de d\u00e9veloppement professionnel continu ;\u00a0<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">les crit\u00e8res de r\u00e9partition de la prime de service, de la prime forfaitaire technique et de la prime de technicit\u00e9 ;\u00a0<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">la politique sociale, les modalit\u00e9s de la politique d\u2019int\u00e9ressement ainsi que le bilan social ;\u00a0<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">la politique d\u2019am\u00e9lioration continue de la qualit\u00e9, de la s\u00e9curit\u00e9 des soins et de la gestion des risques ainsi que les conditions d\u2019accueil et de prise en charge des usagers ;\u00a0<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">le r\u00e8glement int\u00e9rieur de l\u2019\u00e9tablissement.\u00a0<\/span><\/li>\n<\/ul>\n<p class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">Outre les comp\u00e9tences consultatives, la CME et le CTE sont \u00e9galement inform\u00e9s.\u00a0<\/span><\/p>\n<p class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">En ce qui concerne la CME, le d\u00e9cret du 20 septembre proc\u00e8de \u00e0 un jeu de vase communicant faisant \u00ab remonter \u00bb d\u2019anciennes comp\u00e9tences en information en comp\u00e9tences consultatives\u2008<\/span><span class=\"char-TC_txt-Local-5\"><sup class=\"appel\" data-toggle=\"modal\" data-target=\"#notes\">(4)<\/sup><\/span><span class=\"char-TC_txt-Local-3\">. Pour le CTE, le dispositif ant\u00e9rieur demeure inchang\u00e9\u2008<\/span><span class=\"char-TC_txt-Local-5\"><sup class=\"appel\" data-toggle=\"modal\" data-target=\"#notes\">(5)<\/sup><\/span><span class=\"char-TC_txt-Local-3\">.\u00a0<\/span><\/p>\n<p class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">Au total, en ce qui concerne les comp\u00e9tences de la CME et du CTE, les deux d\u00e9crets proc\u00e8dent, aux fins de renforcement de la d\u00e9mocratie \u00e0 l\u2019h\u00f4pital et du dialogue social, objectifs affich\u00e9s du Pacte de confiance, \u00e0 un \u00e9largissement des comp\u00e9tences consultatives, soit par cr\u00e9ation de nouvelles comp\u00e9tences consultatives, soit par transfert d\u2019anciennes informations en consultations.<br \/>\n<\/span><\/p>\n<p class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">Il a \u00e9t\u00e9 rappel\u00e9 plus haut que la composition et l\u2019organisation interne de la CME demeurent de la libert\u00e9 de chaque \u00e9tablissement, via son r\u00e8glement int\u00e9rieur. Le d\u00e9cret sur la CME n\u2019apporte en la mati\u00e8re que de marginales modifications :\u00a0<\/span><\/p>\n<ul>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">la repr\u00e9sentation des sages-femmes au sein de la CME ne sera plus singuli\u00e8re mais plurielle ;\u00a0<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">le directeur, pr\u00e9sident du directoire, d\u00e9signe les repr\u00e9sentants des internes en lieu et place du directeur g\u00e9n\u00e9ral de l\u2019agence r\u00e9gionale de sant\u00e9 ;\u00a0<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">dans les CHU, une repr\u00e9sentation des \u00e9tudiants hospitaliers est cr\u00e9\u00e9e \u00e0 hauteur de quatre repr\u00e9sentants d\u00e9sign\u00e9s, pour deux ans, par le directeur, pr\u00e9sident du directoire ;<br \/>\n<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">toujours dans les CHU, lorsque les personnels enseignants et universitaires repr\u00e9sentent moins de 10% des praticiens titulaires de l\u2019\u00e9tablissement, il peut \u00eatre d\u00e9rog\u00e9, dans le r\u00e8glement int\u00e9rieur de l\u2019\u00e9tablissement, \u00e0 la r\u00e8gle de parit\u00e9 entre les repr\u00e9sentants \u00e9lus des personnels enseignants et hospitaliers titulaires et les repr\u00e9sentants \u00e9lus des praticiens hospitaliers titulaires.\u00a0<\/span><\/li>\n<\/ul>\n<p class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">Enfin, le d\u00e9cret modifie certaines dispositions relatives \u00e0 la pr\u00e9sidence de la CME\u00a0:\u00a0<\/span><\/p>\n<ul>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">il est pr\u00e9cis\u00e9 que lorsqu\u2019un chef de p\u00f4le est \u00e9lu pr\u00e9sident de la CME et qu\u2019il perd, en cours de mandat, la qualit\u00e9 de chef de p\u00f4le, il continue d\u2019exercer son mandat de pr\u00e9sident ;\u00a0<\/span><\/li>\n<li class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">dans les seuls CHU, en cas d\u2019absence de candidat parmi les personnels enseignants et universitaires, le pr\u00e9sident peut \u00eatre \u00e9lu parmi les praticiens titulaires de l\u2019\u00e9tablissement.\u00a0<\/span><\/li>\n<\/ul>\n<p class=\"para-TC_txt_lettrine-Local-11\"><span class=\"char-TC_txt-Local-3\">Voil\u00e0 pour ce qui est de la CME et du CTE au titre du renforcement de la d\u00e9mocratie \u00e0 l\u2019h\u00f4pital et de l\u2019instauration d\u2019une gouvernance \u00e9quilibr\u00e9e. Notons que le texte sur la commission des soins infirmiers, de r\u00e9\u00e9ducation et m\u00e9dico-techniques (CSIRMT) qui devait \u00eatre publi\u00e9 en \u00ab bouquet \u00bb avec ces deux textes sera publi\u00e9 ult\u00e9rieurement comme d\u2019ailleurs celui relatif au comit\u00e9 d\u2019hygi\u00e8ne, de s\u00e9curit\u00e9 et des conditions de travail (CHSCT). Il n\u2019en demeure pas moins que la Conf\u00e9rence des pr\u00e9sidents de CME de CHU a qualifi\u00e9 \u00ab<\/span>\u00a0<em><span class=\"char-TC_txt_ital-Local-10\">d\u2019avanc\u00e9e importante pour la d\u00e9mocratie interne \u00e0 l\u2019h\u00f4pital<\/span><\/em>\u00a0<span class=\"char-TC_txt-Local-3\">\u00bb le r\u00e9tablissement des CME dans plusieurs de leurs pr\u00e9rogatives fondamentales. Pour autant, selon la Conf\u00e9rence, il convient aussi de r\u00e9former les modalit\u00e9s de d\u00e9signation des chefs de p\u00f4le et de signature des contrats de p\u00f4le\u2008<\/span><span class=\"char-TC_txt-Local-5\"><sup class=\"appel\" data-toggle=\"modal\" data-target=\"#notes\">(6)<\/sup><\/span><span class=\"char-TC_txt-Local-3\">.
