Le financement et la construction peuvent \u00eatre r\u00e9alis\u00e9s en un temps tr\u00e8s court (trois \u00e0 quatre ans, parfois moins selon l\u2019importance de l\u2019ouvrage) et l\u2019exploitation peut durer en moyenne trente ans. L\u2019emphyt\u00e9ote assure ce service sous sa responsabilit\u00e9 et l\u2019EPS, s\u2019il s\u2019agit d\u2019un h\u00f4pital, paye en contrepartie un loyer annuel pendant ce bail. Les avantages d\u2019un tel partenariat sont certains\u2009: il r\u00e9sout la question du financement, il \u00e9vite \u00e0 l\u2019h\u00f4pital la charge de la construction et il r\u00e8gle l\u2019important probl\u00e8me de la maintenance de l\u2019ouvrage pendant la dur\u00e9e du bail.<\/p>\n<p>Si ces \u00e9l\u00e9ments sont s\u00e9duisants en th\u00e9orie et parfois r\u00e9els en pratique selon le type de l\u2019ouvrage public, les exp\u00e9riences n\u2019ont pas \u00e9t\u00e9 concluantes pour l\u2019ensemble des \u00e9tablissements ayant men\u00e9 une telle d\u00e9marche. Toute une litt\u00e9rature existe sur cette question, ainsi que plusieurs rapports des chambres r\u00e9gionales des comptes, de l\u2019Inspection g\u00e9n\u00e9rale des affaires sociales (Igas) ou autres organismes, officiels ou non\u2009:<\/p>\n<ul>\n<li>pour conclure ce type de \u00ab\u2009montage\u2009\u00bb complexe, il est n\u00e9cessaire que l\u2019EPS dispose d\u2019un \u00e9tat-major juridique, technique et financier solide. Ce qui n\u2019a pas toujours \u00e9t\u00e9 le cas lors des p\u00e9riodes de n\u00e9gociations du PPP\u2009;<\/li>\n<li>l\u2019EPS doit \u00eatre aid\u00e9 par ses tutelles sur les plans technique et juridique. C\u2019est d\u2019autant plus vrai lorsque le BEH couvre un p\u00e9rim\u00e8tre large (et pas uniquement un b\u00e2timent logistique ou un p\u00f4le d\u2019activit\u00e9 clinique). Ainsi, l\u2019appui se doit d\u2019\u00eatre plus dense pour un BEH int\u00e9gral (conception-r\u00e9alisation-financement-exploitation) et pour les projets cons\u00e9quents. La taille de l\u2019\u00e9tablissement compte, ainsi que les attributs des activit\u00e9s r\u00e9alis\u00e9es en BEH (h\u00e9bergement, plateau technique et logistique). Malgr\u00e9 quelques exp\u00e9riences r\u00e9centes, ce type de montage reste rare\u2009;<\/li>\n<li>des conflits ont souvent \u00e9maill\u00e9 la conception et la construction des ouvrages. Un des avantages majeurs du PPP \u00e9tant la rapidit\u00e9 de conception et la tenue des d\u00e9lais, ces conflits peuvent induire des retards de plusieurs mois pour la \u00ab\u2009remise des cl\u00e9s\u2009\u00bb de l\u2019ouvrage et donc pour l\u2019ouverture effective du b\u00e2timent. La qualit\u00e9 du dialogue \u2013 et, en creux, les possibilit\u00e9s d\u2019analyse et d\u2019expertise des deux parties sur le projet \u2013 conditionne\u00a0la v\u00e9locit\u00e9 de la r\u00e9alisation\u2009;<\/li>\n<li>la maintenance des ouvrages (quand elle est incluse dans le p\u00e9rim\u00e8tre des BEH) ne doit pas \u00eatre sous-estim\u00e9e sous peine de probl\u00e8mes quotidiens dans l\u2019exploitation de l\u2019ouvrage. Il convient de ne pas perdre de vue la nature des b\u00e2timents r\u00e9alis\u00e9s. Il s\u2019agit de structures sanitaires occup\u00e9s par des patients 365\u00a0jours par an et 24\u2009h\/24. La qualit\u00e9 et la s\u00e9curit\u00e9 du b\u00e2timent doivent donc \u00eatre respect\u00e9es \u00e0 tout moment.<\/li>\n<\/ul>\n<h1>Sortir du BEH\u2009: une possibilit\u00e9\u2009?<\/h1>\n<p>Ce qui suit ne saurait \u00eatre consid\u00e9r\u00e9 comme des conclusions g\u00e9n\u00e9rales et absolues applicables \u00e0 tout BEH hospitalier. Les EPS \u00e9tudiant la sortie d\u2019un BEH le font sur quatre crit\u00e8res particuliers\u2009:<\/p>\n<ul>\n<li>des situations financi\u00e8res tendues de mani\u00e8re p\u00e9renne. Pour certains EPS, le loyer annuel repr\u00e9sente un pourcentage consid\u00e9r\u00e9 comme excessif par rapport \u00e0 leurs recettes d\u2019exploitation. Payer ces loyers revient en quelque sorte \u00e0 compromettre leur situation financi\u00e8re\u2009;<\/li>\n<li>la sp\u00e9cificit\u00e9 et l\u2019importance de la maintenance\/exploitation d\u2019un EPS qui ne peut se permettre de fermer des lits ou des services durablement et qui doit veiller \u00e0 la qualit\u00e9\/s\u00e9curit\u00e9 des soins en tout temps\u2009;<\/li>\n<li>un EPS ne dispose pas de ses locaux \u2013 il n\u2019en est pas le propri\u00e9taire, en la nature de ses emprunts, ceux-ci sont g\u00e9r\u00e9s par l\u2019emphyt\u00e9ote \u2013 et il ne peut en faire \u00e9voluer l\u2019architecture en fonction des changements th\u00e9rapeutiques sans frais suppl\u00e9mentaires non pr\u00e9vus au contrat\u2009;<\/li>\n<li>la d\u00e9pendance de l\u2019EPS pour tout ou partie des questions de maintenance et d\u2019exploitation. Si une partie de la maintenance\/exploitation a \u00e9t\u00e9 d\u00e9l\u00e9gu\u00e9e au partenaire priv\u00e9, l\u2019EPS ne dispose souvent plus des \u00e9quipes techniques en nombre suffisant pour g\u00e9rer ses enjeux.<\/li>\n<\/ul>\n<p>Les potentiels protocoles de sortie sont l\u2019objet de discussions longues entre les partenaires. Sans entrer dans les cas particuliers, ces derniers doivent tenir compte des enjeux suivants\u2009:<\/p>\n<ul>\n<li>la d\u00e9finition d\u2019une p\u00e9riode transitoire afin de laisser le temps aux EPS concern\u00e9s de reconstituer une \u00e9quipe de services techniques\u2009;<\/li>\n<li>la d\u00e9termination d\u2019un calendrier de reprise de la propri\u00e9t\u00e9 et de l\u2019ouvrage ainsi que de l\u2019ensemble des contrats de pr\u00eats et de couverture de taux dont disposait l\u2019emphyt\u00e9ote pour mener le projet\u2009;<\/li>\n<li>le calendrier de reprise de la maintenance-exploitation, si elle faisait partie du BEH, par l\u2019h\u00f4pital, ce dernier redevenant un ma\u00eetre d\u2019ouvrage classique.<\/li>\n<\/ul>\n<script>function PlayerjsAsync(){} if(window[\"Playerjs\"]){PlayerjsAsync();}<\/script>","protected":false},"excerpt":{"rendered":"<p><span class=\"span-reading-time rt-reading-time\" style=\"display: block;\"><span class=\"rt-label rt-prefix\">Temps de lecture\u00a0: <\/span> <span class=\"rt-time\"> 3<\/span> <span class=\"rt-label rt-postfix\">minutes<\/span><\/span>Dans une situation financi\u00e8rement contrainte pour des raisons endog\u00e8nes et exog\u00e8nes, le bail emphyt\u00e9otique hospitalier (BEH) a incontestablement des avantages et un principe fond\u00e9.
